摘要
扫黑除恶专项行动所取得的丰硕成果主要集中于线下犯罪。在常态化扫黑除恶形势下,如何通过加强检察机关的法律监督作用,有效惩治网络黑社会性质组织犯罪值得研究。网络黑社会性质组织犯罪的法治滥觞、概念厘定和特征描述是加强检察机关法律监督作用的前置考量。由于网络黑社会性质组织犯罪隐数不明、立案数量少、社会危害性大、待证事实多、犯罪构成复杂、认定困难大,检察机关需要逐步整合对网络黑社会性质组织犯罪的法律监督路径,从注重线索和证据维度逐步加强立案监督,从严格证明标准维度自觉压实公诉监督,从准确判断构罪条件维度积极推进审判监督。
The fruitful results achieved by the special campaign against gangsterism and evil mainly focus on offline crimes.Under the normalized eradication of gangsters and evil,it is worth studying how to effectively punish network underworld-organized crimes by strengthening the legal supervision of procuratorial organs.The origin of rule of law,concept determination and characterization of network underworld-organized crime are the preconditions for strengthening the legal supervision of procuratorial organs.Due to the unknown number,the small number of cases on file,the great social harm,many facts to be proven,the complex crime composition and the great difficulty in identification of network underworld-organized crimes,the procuratorial organs need to gradually integrate the legal supervision path for network underworld-organized crimes,to gradually strengthen the supervision of case filing from the dimension of focusing on the clues and evidence,to consciously compact the supervision of public prosecution from the dimension of strict proof standards,and to actively promote the supervision of trial from the dimension of accurately judging the conditions of culpability.
