摘要
数据库容量大、检索方便,能极大地提升搜索资料的便捷性,也成为传统出版社数字化转型的一个重要方向。但是,数据库涉及海量作品,获取海量著作权授权的难题已成为其发展的瓶颈。数据库出版中,根据作品类型的不同,可以通过合理使用、法定许可和授权使用三种不同的模式依法使用他人作品。文章以我国历届获奖数据库出版物为样本进行研究,发现我国传统出版社的数据库出版实践仍集中于自有资源,未来的发展方向应为拓展数据库类型,力图在现有著作权法律框架下,最大程度地开发数据库出版的发展潜力。
With large information capacity and easy retrieval,databases can greatly enhance the convenience of information searching and have become an important trend for the digital transformation of traditional publishing houses.However,databases involve massive works,and the difficulty of acquiring massive copyright authorization has become a bottleneck for their development.In database publishing,depending on the types of works,works of others can be used legally through three different modes of fair use,statutory license and authorized use.The article takes the previous award-winning database publications in China as samples for research,and finds that the database publishing practice of traditional publishing houses in China rely heavily on their existing resources.In response to this issue,it’s pointed out that the future development direction should be to expand the types of databases and to tap the potential of database publishing to the maximum extent under the existing legal framework.
