摘要
野生动物是自然生态系统的重要组成部分,生态文明建设需要科学把握人与野生动物的和谐关系,构建人与野生动物共存的新秩序。野生动物肇事公众责任保险作为目前我国缓解人兽冲突的重要经济手段日益引起公众关注,文中基于对野生动物肇事公众责任保险制度利益相关者的分析,包括利益主体的利益诉求和利益主体之间存在的矛盾以及权利与义务,指出野生动物肇事公众责任保险制度具有财政资金利用效率提升、肇事补偿工作专业高效、肇事损失赔偿标准提高等优势,但在制度运行、监督管理、实施效果等方面仍存在不足;从政府、保险公司、群众3个利益主体角度提出加强顶层设计、完善制度机制,提高业务水平、注重人才培养,增强生态保护、提高保险意识的建议,以期为野生动物肇事公众责任保险的普及和发展完善提供参考。
Wildlife is an important part of the natural ecosystem.The construction of ecological civilization needs to scientifically grasp the harmonious relationship between man and wildlife and build a new order for the coexistence of man and wildlife.As an important economic means to alleviate human-animal conflicts in China,public liability insurance for wildlife accidents has attracted increasing public attention.Based on the analysis of the stakeholders of the public liability insurance system for wildlife accidents,including the interest demands of the stakeholders and the contradictions between the stakeholders,as well as the rights and obligations,this paper points out that the public liability insurance system for wildlife accidents has the advantages of improving the utilization efficiency of financial funds,professional and efficient accident compensation work and improving the compensation standard for accident losses,but in the process of system operation,supervision and management,there are still deficiencies in the implementation effect.Based on this,from the perspective of the government,insurance companies and the public,this paper puts forward some suggestions on strengthening the top-level design,improving the system and mechanism,improving the business level,paying attention to talent training,enhancing the ecological awareness and improving the insurance awareness,in order to provide reference for the popularization,development and improvement of public liability insurance for wildlife accidents.
