摘要
《洪德法典》,亦称《国朝刑律》或《黎朝刑律》,是古代越南黎朝时期颁布的一部法典,也是越南迄今为止保存最为完整的一部古代法典。纵观这部法典,从篇章体例、八议制度、十恶制度、五刑、亲属相隐等,从结构到内容,都能找到唐律的影子。同时,《洪德法典》也并非唐律等我国古代法律的翻版,在结构和内容,乃至一些制度上都有自己的特点。可以看出,这是一部以我国唐律为蓝本制定的诸法合体的综合性法典。研究这部法典中的刑事制度,可以深入了解我国古代刑事法律文化如何影响了东南亚各国的法律制度。
The Hongde Code,also known as The Criminal Law of the Current Dynasty,or The Criminal Law of Le Dynasty,is a code promulgated during the Le Dynasty of the ancient Vietnam.It is also the most complete ancient code in Vietnam so far.Throughout this code,we could find the shadow of the Tang Code from its structure to content,in its textual style,Eight Type of Privileged Criminals,Ten Offences,Five Penalties,Relative Concealment Formulations and so on.However,Hongde Code is not exactly a replica of the Tang Code or other ancient Chinese laws.It also keeps its own characteristics in its layout and contents.In this way,we can say that Hongde Code is a comprehensive code of laws enacted based on the Tang Code.Studies on the criminal system in Hongde Code could give us an in-depth understanding of how ancient Chinese criminal laws and culture had affected that of countries from Southeastern Asia.
