摘要
“双减”政策矫正学科培训的市场失灵,实质性地保障了未成年人的成长权利,是一项重大的社会福利改进。其成功秘诀在于,它介入并调整儿童、家庭、机构、学校和政府之间的群己权界。“双减”政策代表了当代中国家国关系的一大变动,它表明,经历了改革开放之后的家国分离,国家再次介入家庭,其基本背景是家庭无力履行充分的人口再生产职能。家国同构说的兴起反映了一部分人试图拯救家庭功能萎缩的复古愿望,但从根本上讲,它不足以适应当代中国的家国关系,也误解了整个社会的群己关系。理想意义上的家国关系应当是家国互嵌,它坚持人身多级所有权,实施以人民为中心的政府介入,并根据不同的具体情境而采取适当的权利嵌入方式。
The policy of“double reduction”corrects the market failure of discipline training,substantially protects the growth rights of minors,which is a major social welfare improvement.The secret of its success lies in its intervention and adjustment of the group power demarcation among children,families,institutions,schools and the government.The“double reduction”policy represents a major change in contemporary China’s family-state relationship.It shows that after the separation of family and state after the Reform and Opening Up,the state intervenes in the family again.The basic background is that the family is unable to perform the full function of population reproduction.The rise of family-state isomorphism reflects the retro desire of some people to save the shrinking family function,but fundamentally speaking,it is not enough to adapt to the relationship of family and state in contemporary China,and it also misunderstands the group selfrelationship in the whole society.Ideally,the relationship between family and state should be that family and state are embedded in each other.It adheres to the multi-level ownership of the person,implements the peoplecentered government intervention,and adopts appropriate rights embedding methods according to different specific situations.
