摘要
随着我国刑事犯罪结构发生显著变化,严重暴力犯罪数量与重刑率的下降、轻微犯罪数量与轻刑率的上升(即“双降双升”),犯罪治理迎来了新挑战,轻罪、新罪成为犯罪治理的主要对象。本文认为,断言轻罪时代已经来临,既是基于客观统计数据的科学分析,更是基于国家关于社会治理战略决策的理性判断。犯罪结构轻罪化是长期趋势而非短期现象,应当归功于中华人民共和国成立以来特别是改革开放以来我们在犯罪治理领域长期艰苦的努力、刑事立法的及时有效应对以及司法系统的积极主动作为。轻罪时代论断的提出,要求我们尽快调整既有的犯罪治理体系及思想观念,完善社会治理体系,大力推行犯罪治理的法治化、科学化,从而提升犯罪治理的效能,建设更高水平的平安中国。
With the remarkable changes in the structure of criminal offenses in China,the decline in the number of serious violent crimes and the rate of heavy sentences,and the rise in the number of minor crimes and the rate of light sentences(that is,"double drops and double rises"),criminal governance has ushered in new challenges,and minor crimes and new crimes have become the main targets of criminal governance.This article argues that the era of asserting minor crimes has arrived is not only a scientific analysis based on objective statistics,but also a rational judgment based on the state's strategic decision-making on social governance.The misdemeanor trend of criminal structures is a long-term trend rather than a short-term phenomenon,which should be attributed to our long-term and arduous efforts in the field of crime governance since the founding of the People's Republic of China,especially since the reform and opening up,the timely and effective response to criminal legislation,and the proactive actions of the judicial system.The proposition of the thesis of minor crimes era requires us to adjust the existing crime governance system and ideas as soon as possible,improve the social governance system,and vigorously promote the rule of law and scientization of crime governance,so as to greatly improve the efficiency of crime governance and build a higher level of safe China.
