摘要
良好的风险识别机制是数据跨境流动风险分析研判、处理归档的基础。当前,我国采取数据本地化政策对数据跨境活动进行“入境审核,出境评估”,在我国服务器进行数据跨境流动风险识别,但在实践中识别效率和安全性还有所欠缺。基于智能合约技术的运行机制原理,分析智能合约技术运行于数据跨境流动风险识别机制的可行性,并构建基于智能合约技术的数据跨境流动风险识别机制。结合智能合约理论和风险识别实践,应当从广度和深度上树立风险识别意识,提升数据跨境流动风险感知与识别水平,完善数据跨境流动风险识别机制的构建方法,实现维护数据主权、构建“网络空间命运共同体”的长久之计。
A good risk identification mechanism is the basis for cross-border risk analysis,processing and archiving.Currently,China has adopted a data localization policy to conduct“entry screening and exit assessment”for cross-border data activities,and to identify the risks of cross-border data in China’s servers,but the capability is insufficient in terms of identification efficiency and security.Based on the operation mechanism principles of smart contract technology,the feasibility of smart contract technology operating in the risk mechanism of cross-border data flow is analyzed,and the risk mechanism of cross-border data flow based on smart contract technology is constructed.Combined with the smart contract theories and risk identification practice,this paper contends efforts should be made to raise risk identification awareness in both the breadth and the depth,develop the level of risk perception and identification of cross-border data flows,improve the construction method of cross-border data risk mechanism,so as to achieve a long-term plan to safeguard data sovereignty and build a“cyberspace community of shared future”.
