摘要
新城规划建设承载着诸多公共政策目标,需要有法制保障及健全的治理体系;我国新时代的新城规划建设也要在政策框架和法制保障方面做出创新探索。首先辨析我国新城运作的制度基础和法制诉求;然后在阐述英国新城规划建设中的法制演进历程及介绍各版《新城法》主要内容的基础上,分析英国新城立法活动的主要特征;最后探讨对当前新城规划建设的若干启示:一是新城的规划和实施要与国家的整体规划体系相契合,二是新城的“新”应具有时效性,三是新城的事权要在立法或政策文件中加以明确规定,四是要加强新城规划建设的地方立法。
The new town development carries several public policy objectives that should be backed by legislation as well as effective governance.In terms of China’s new town planning and development in the new era,a policy framework and legal system need to be explored.This paper analyzes the institutional basis and legal demands of China’s new town development,then expounds the evolution of the legal system in the new town’s planning and development in the United Kingdom,including the content of various versions of the New Town Act and the characteristics of the legislative activities.Finally,some enlightenment is discussed.First,the planning and implementation of new towns should be in line with the overall planning system of the country.Second,the"new"of new towns should be kept time-sensitive.Third,the administrative powers of new towns should be clearly defined in legislation or policy documents.Fourth,it is suggested to promote local legislation on new town issues.
