摘要 政府数据开放所可能面临的负面效应,并不能构成对政府数据开放必要性的根本影响,可以通过合理的制度构建加以防范和避免。就相关理论制度横向比较而言,政府数据开放与政府信息公开从法理基础和制度构造上存在根本差异,并无先后承接或由此及彼的关系,但在实现的效果上却存在部分重叠。而基于数据与自然资源的本质区别,政府数据开放虽然不能完全套用自然资源管理制度,但在公私法权利的承接等方面有很多借鉴价值。此外,对于政府数据开放行为的性质,需结合直接开放和引入第三方进行开放两种主要开放模式加以考量。直接开放模式下,政府与相对人形成民事合同;而引入第三方进行开放模式下,则存有两段行为过程,相对人之间可能构成民事合同加民事合同或民事合同加行政合同。 The negative effects that government data openness may face do not constitute a fundamental impact on the necessity of government data openness and can be prevented and avoided through reasonable institutional construction.In terms of horizontal comparison of related theoretical systems,there are fundamental differences between open government data and open government information in terms of legal basis and institutional structure,and there is no successive or consequential relationship,but there is a partial overlap in the effect of realization.Based on the essential difference between data and natural resources,although government data openness cannot be fully applied to the natural resources management system,there is a lot of value to be learned from it in terms of public and private law right undertaking.In addition,the nature of government data openness should be considered in the context of two major openness models:direct openness and openness by third parties.Under the direct opening model,the government and the counterparty form a civil contract,while under the introduction of a third party to open up,there are two processes,which may constitute a civil contract plus a civil contract or a civil contract plus an administrative contract between the counterparties.
