摘要
作为综合行政执法改革的核心要素,城管执法力量下沉至基层已被正式写入《中华人民共和国行政处罚法》。城管执法力量下沉虽能满足基层的刚性治理需求,但政策执行过程中衍生的诸多问题亦值得关注。借鉴光学理论和行政生态学的思想,本文分析了城管执法力量下沉的“衍射”现象。基于上海的实证调查发现,下沉的城管执法力量在穿越不同行政组织的“窄缝”到达治理场域时,发生了政策“衍射”的情况,并导致城管职权扩张、队伍发展活力下降、复杂问题执法能力弱化等偏离“直射”方向的问题。因此,应从承接政府与下沉城管的权责边界厘定、城管队伍的条块统合、复杂事务治理的管执联动三个方面提升政策实施的整体性效果。
As the core elements of reformation of the Comprehensive Administrative Law-Enforcement,transferring law enforcement forces of urban management into lower level has been officially involved into the Administrative Punishment Law of the People’s Republic of China.The reformation is satisfying the needs of grassroot level for rigid governance and management indeed.However,the problems arising from the process while implementing the policies are still worth to be discussed.Taking reference from optical theories and ecology of public administration,this paper analyses the“diffraction”phenomenon of transferring law enforcement forces of urban management into lower level.Our recent empirical studies in Shanghai shown that the diffraction occurs when the enforcement level is penetrating different administrative organs prior to the destinated governance location.Leading off the situation,a series of problems incurred the deviation from the policy such as power expansion of law enforcement of Urban Management Level,vitality of team development and the weakness of dealing with complicated issues,etc.In view of this,it is suggested to focus the enhancement on three major aspects in order to improve the holistic efficiency of the policy implementation.Firstly,a clear determination and classification of the authorities and responsibilities of each delegated parties.Secondly,integration of the Urban Management team and lastly,the interaction and coordination between urban management teams and law enforcement teams for the complicated issues to be managed.
