摘要
网络服务国家安全审查足以满足当前国际投资条约对于“投资”这一概念的界定,与一国境内投资相关的境外服务也完全可能整体构成“投资”。将投资条约适用于网络服务国家安全审查可知,“安全”一词的高度主观性意味着无法通过非歧视原则评价网络服务国家安全审查的合法性。可能适用于此的国际投资规则包括“公平公正待遇”项下的“正当程序”问题,以及“征收”项下的“比例原则”问题。此外,“安全例外”的存在同样不能豁免东道国的征收补偿义务。我国目前既存在大量的互联网企业进行海外投资,也存在足以吸引外资进入的广阔互联网市场,因而须在未来缔约中通过数字贸易章节弥补投资章节的规则模糊性,同时完善我国网络安全审查的程序性规则。
The Network Services National Security Review is sufficient to meet the definition of the term“investment”in current international investment treaties.Moreover,it is entirely possible that overseas services related to investments within the territory of a country constitute“investments”as a whole.The application of investment treaties to cyber services national security reviews shows that the highly subjective nature of the term“security”means that the legality of national security reviews of cyber services cannot be evaluated through the principle of non-discrimination.International investment rules that may apply include the issue of“due process”under“fair and equitable treatment”and the“principle of proportionality”under“expropriation”.In addition,the existence of a“security exception”does not exempt the host State from its obligation to compensate for expropriation.At present,there are a large number of Internet enterprises in China making overseas investments.China also has a vast Internet market that is sufficient to attract foreign investment.Therefore it is necessary to supplement the ambiguity of the investment chapter through the digital trade chapter in future treaty conclusion,and at the same time improve the procedural rules for China’s network security review.
