摘要
鉴于现行涉矿法律、法规内在的滞后性以及矿业权本身兼具民事物权和行政许可双重特性,导致司法对涉矿法律、法规的理解差异较大,裁判标准不一。本文在总结现有裁判思路的基础上,结合《民法典》的最新规定,认为“未生效说”最为契合现行法的规定,亦符合逻辑法理,并为实践所广泛认可,应将“未生效”视为未经批准矿业权转让合同效力的应然状态。
In view of the hysteresis quality of the existing mine-related laws and regulations,and the mining right has the dual characteristics of civil real right and administrative license,the understanding of the mine-related laws and the judicial standard were differ.On the basis of the summary of the judgment thoughts,and according to the regulations of The Civil Code,the paper suggests that the theory of“ineffective”is the most consistent with the provisions of the current law,is also in line with the logic principle,and is widely accepted in practice.Therefore“ineffective”should be regarded as the natural statement of the contract for transfer of unauthorized mining right.
