摘要
近年来,国家法定考试作弊屡禁不止,严重危害了国家统一考试的权威性,破坏了社会的公平正义,侵害了广大诚实考生的正当权益,公安机关必须保持“零容忍”。“助考”类犯罪呈现出惯犯累犯作案多、准入类资格考试作弊多、培训机构推波助澜、犯罪活动覆盖面广、社会分工精细、助考设备更新迭代迅速等特点。在打击“助考”类犯罪过程中存在犯罪嫌疑人反侦查意识强、考试作弊器材难查处、犯罪团伙分散难打击、战果难认定等难点。从侦查对策和预防犯罪的角度来看,完善法律法规,同时强化公安机关以专业侦查打职业犯罪、考试主管部门以监管补漏洞、无线电相关职能部门以强力促效能的能力,坚决防止发生影响考试安全的重大案事件,努力营造公平公正的考试环境,切实维护社会治安大局稳定。
In recent years,cheating in the national level examination has emerged repeatedly is prohibited,which seriously endangers the authority of national examination,undermines the social fairness,justice and integrity system and infringes upon the legitimate rights and interests of the majority of candidates.Public security organs must maintain "zero tolerance"."Exam assistance" crimes have the characteristics of repeat offenders committing crimes,cheating in admission qualification examinations,driving by training institutions,wide coverage of criminal activities,fine social division of labor and rapid update of examination-assistance equipment.In the process of cracking down on "exam assistance" crimes,there are difficulties in the strong anti-investigation awareness of criminal suspects,in investigating and handling cheating equipment in exams,in cracking down on the scattered criminal gangs and in identifying investigative results.From the perspective of investigative countermeasures and crime prevention,we should improve laws and regulations and at the same time strengthen the ability of public security organs to specialize in cracking down professional crimes,the ability of examination authorities to fill loopholes in supervision and the ability of radio-related functional departments to vigorously promote efficiency,so as to resolutely prevent major incidents affecting the safety of examinations,to create a fair and just examination environment and to maintain the overall stability of social security.
