摘要
我国首例网络音乐播放平台市场反垄断处罚呈现了当前市场的竞争损害:版权流通障碍、用户权益受损、平台发展受限。其根源在于代理平台滥用市场支配地位、少数平台与版权方的纵向垄断协议、大型播放平台违法集中三种垄断行为。然而,本案仅对经营者集中行为作出评价,对“恢复到集中前状态”的首次应用也待优化。故此,一是可以提高规制滥用市场支配地位的精确度,将音乐获取渠道增添为测算维度,适用共同市场支配地位认定标准;二是可以明晰纵向垄断协议的违法性判断,以专项调查识别并公开版权价格因素的变化,并明确非价格型纵向垄断协议的构成要件;三是可以完善经营者集中的配套制度,明确VIE架构平台合并的审查标准,提高审查效率并完善救济途径。
China's first anti-monopoly penalty in the online music playing platform market presents the current competitive damage in the market:barriers to copyright circulation,damage to users rights and restrictions on platform development.It is rooted in three types of monopolistic conduct:abuse of dominant market position by agency platforms,vertical monopoly agreements between a few platforms and copyright holders,and illegal concentration by large broadcasting platforms.However,this case only evaluates the concentration of operators,and the first application of“restoration to pre-concentration status”has yet to be optimized.Therefore,firstly,the accuracy of the regulation of abuse of market dominance can be improved by adding the access to music as a measurement dimension and applying the criteria for the determination of common market dominance.Secondly,the illegality of vertical monopoly agreements can be clarified by identifying and disclosing the changes in copyright price factors through special investigations and clarifying the elements of non-price vertical monopoly agreements.Thirdly,the supporting system for the concentration of operators can be improved by clarifying the examination criteria for the merger of VIE structured platforms,improving the efficiency of the review and the avenues of redress.
