摘要
德国参审制历史悠久,是大陆法系国家参审制的典型代表。德国参审制的内容由参审范围、遴选机制、参审员参加庭审、上诉机制等方面组成。从比较法上说,德国参审制在参审员职权分配、随机遴选制度、有限制的参审员阅卷制度、书面判决说理制度方面独具特色。德国参审制在运行过程中,取得显著功效,但也存在参审员代表性不足、参审过程法官主导性过强、参审员管理职业化等问题,制约制度效用的发挥。然而,任何制度都不是完美的,应该正视德国参审制的优劣。德国参审制对我国的人民陪审员制度改革具有重大的借鉴和启示意义。
Germany has a long history of Lay Participation system and is a typical representative of Lay Participation system in civil law countries.The content of the German Lay Participation system consists of the scope of the trial,the selection mechanism,the participation of the judges in the trial,and the appeal mechanism.From the perspective of comparative law,the German system of participation in the review is unique in the distribution of the powers of the reviewers,the random selection system,the defined right=of=access=to=case=files,and the written judgment system.In the process of operation,the German Lay Participation System has achieved remarkable efficacy,but there are also problems such as the Lay people lacking of representation,the dominance of judges in the trial process,and the management professionalism of judges,which restrict the play of the system.However,no system is perfect,and the merits of the German participation system should be faced.The German Lay Participation System is of great significance to the reform of the people’s jury system in China.
