摘要 利用网络爬虫暴力爬取作品数据的行为除侵犯国家著作权管理制度及他人著作权权益外,亦实质性侵害计算机系统安全。传统司法实践仅从数据内容是否落入著作权规制范围内加以类型化保护,无法全面评价该行为的社会危害性。利用网络爬虫暴力爬取作品数据行为客观上造成侵犯计算机信息系统安全的危害后果,侵害数据的保密性、完整性和可用性。应采用想象竞合的罪数认定立场,以全面评价暴力爬取数据行为在技术层面与数据内容层面所造成的不同侵害。 In addition to violating the national copyright management system and individual copyright rights,the act of violent crawling of work data also substantially infringes on the security of the computer system.Traditional judicial practice only protects the data from whether it falls within the scope of copyright,which cannot fully evaluate the social harm of this behavior.The act of violent crawling of data objectively not only causes the harmful consequences of violating the security of the computer information system but also infringes on the confidentiality,integrity,and availability of data.It is essential to adopt the position of imaginary concurrence to comprehensively evaluate the different violations caused by violent crawling data at the technical and data content level.
