摘要
我国“不方便法院原则”从英美法系的“Forum non Conveniens”移植而来,却发生了“异变”,主要表现为在作为裁量性“标准”的“Forum non Conveniens”中嵌入了确定性“规则”,同时以我国及我国国民利益对该原则进行了“价值锁定”。作为此种“异变”的结果,“不方便法院原则”过度挤压了司法者在个案中的妥善权衡的空间,使得“Forum non Conveniens”原本具有的“制衡原告挑选法院”和“维护本国及本国国民利益”两种功能均受到减损,所追求的“正义”与“利益”两种价值也都难以真正落地,并且无法妥善处理平行诉讼、协议管辖等具体问题,陷入了较为尴尬的境地。该制度移植中出现的“南橘北枳”现象对我国此后的制度引入具有经验意义。
The doctrine of Forum non Conveniens in the Anglo-American legal system was transplanted into China as"Inconvenient Forum Principle",but it has undergone a variation.This principle has inserted elements of rigid"rule"into"Forum non Conveniens"which is a"standard"of discretion,and is"value-locked"for the interests of China and its people.As a consequence of this"variation","Inconvenient Forum Doctrine"has unduly squeezed the space for judiciaries to properly exercise their discretion in real cases and undermined both the functions of"Balancing the plaintiff’s forum shopping"and"Safeguarding the interests of the country and its nationals"which the doctrine of Forum non Conveniens bears.Therefore,the values of"Justice"and"Interests"pursued by"Inconvenient Forum Principle"cannot really come into being.Furthermore,this principle cannot properly deal with parallel proceedings,agreements of election of forums and other specific issues,which has reduced this principle into a more embarrassing situation.The phenomenon of"Oranges change with their environment"appeared in the transplantation of the doctrine of Forum non Conveniens has an empirical significance for the introduction of institutions in the future.
