摘要
在哲学上,习近平法治思想是一个完整的理论体系。在这个理论体系中,本质论、主体论、实践论、方法论和价值论交相呈现、彼此支持。本质论通过阐述“社会主义法治必须坚持党的领导,党的领导必须依靠社会主义法治”等核心命题,深刻揭示了党的领导是社会主义法治区别于其他类型法治的本质所在;主体论通过论述“依法治国必须坚持人民主体地位,必须坚持法治为了人民、依靠人民、造福人民、保护人民”等核心命题,充分证成了只有人民才是社会主义法治建设的主体;实践论通过阐释“鞋子合不合脚,自己穿了才知道”“物之不齐,物之情也”“听言不如观事,观事不如观行”等基本命题,客观呈现出一个真理,即中国特色社会主义法治道路不是从天上掉下来的,而是在中国社会土壤中生长起来的,是经过长期革命、建设、改革实践形成的,是中国法治建设成就和经验的集中体现;方法论通过论证“依宪治国和依宪执政有机统一”“法治国家、法治政府、法治社会一体建设”“国内法治与国际法治统筹推进”等基本路径,系统阐明了依法治国的方法论体系;价值论通过论述“治理体系和治理能力现代化”“社会主义法治国家”“人民美好生活”等关键命题,深入阐释了社会主义法治“中国之治”的总体价值取向。
In philosophy,Xi Jinping′s thought of rule of law is a complete theoretical system.In this theoretical system,essentialism,subject theory,practice theory,methodology and axiology present and support each other.By expounding the core proposition that"the socialist rule of law must adhere to the Party′s leadership,and the Party′s leadership must rely on the socialist rule of law",the essentialism profoundly reveals that the Party′s leadership is the essence of the socialist rule of law,which is different from other types of rule of law.By demonstrating the core propositions of"ruling the country according to law must adhere to the people′s dominant position,and must adhere to the rule of law for the people,relying on the people,benefiting the people and protecting the people",the subject theory fully proves that only the people are the main body of the construction of socialist rule of law.By explaining the basic propositions such as"whether the shoes fit or not,you can′t know until you wear them","things are different","examining a person′s practical actions is better than observing his behaviors and listening to his words",the practice theory objectively presents a truth that the road of socialism rule of law with Chinese characteristics does not fall from the sky,but grows up in the Chinese social environment,is formed through the long-term practice of revolution,construction and reform,and is the concentrated embodiment of China′s achievements and experience in the construction of rule of law.By demonstrating the basic methods of"the organic unity of governing the country in accordance with the Constitution and ruling the state in accordance with the Constitution","the integrated construction of a country under the rule of law,a government under the rule of law and a society under the rule of law","the overall promotion of the domestic rule of law and the international rule of law",methodology systematically expounds the methodological system of the rule of law.By discussing the key propositions
