摘要
福建谘议局是清末立宪运动时期比较活跃的一个议事机构。1910年,议员邹含英向闽浙总督松寿告发谘议局正副议长并四次提出申诉,松寿将此案发回谘议局内部讨论处理,谘议局处理该案有理有据,邹含英终被表决除名。从议事过程来看,质询、回答、表决、申覆等流程均体现出一定的专业水准,是清末议会政治近代化、制度化的一个缩影。从议事结果来看,该案不仅有传统的督抚与谘议局权限之争,而且涉及督抚与谘议局、督抚与议员、谘议局议员之间三组复杂关系,叠加了政事、议事、人事等诸多问题,包含思想观念、法理程序和个人利益之争,体现出议会制度在近代中国具体实践中的困境。
In 1910,Zou Hanying,a member of the Fujian Consultation Bureau,denounced the case of the chairman and vice-chairman of the Council to the Governor-Gereval of Fukien and Chekiang Provinces,Song Shou,and appealed four times,and Song Shou sent the case back to the Council for internal discussion.From the viewpoint of the proceedings,the process of questioning,answering,voting,and replying all reflect a certain level of professionalism,which is a microcosm of the modernization and institutionalization of parliamentary politics in the late Qing Dynasty.From the outcome of the deliberations,the case not only involved the traditional dispute over the Governor and the Consultation Bureau,but also involved three complex sets of relationships between the governor and the Consultation Bureau,the governor and the councilors,and the councilors,overlapping many issues of politics,deliberation,and personnel,including ideology,legal procedures,and personal interests,reflecting the dilemma of the parliamentary system in the concrete practice of modern China.
