摘要
信息化时代掀起了网络庭审的浪潮,但我国刑事案件网络庭审尚处于起步阶段,在理论与现实层面都具有诸多不完善之处。网络庭审的“远程性”对于直接言词原则与最佳证据规则的违背,网络远程证据展示对于质证带来的影响以及网络庭审质证受技术设备制约等问题都给确保网络庭审质证的顺利进行带来一系列难题。因此,有必要明确网络庭审的案件适用条件、强化网络庭审的技术要件、充分利用庭前会议并加强各机关的协作来优化网络庭审质证。
The information age has set off a wave of network trial,but China's criminal case network trial is still in its infancy,it still have many imperfect aspects in theory and reality.The"remote nature"of the network trial brings a series of difficult problems to ensure the smooth progress of the network trial,such as the violation of the principle of direct speech and the rule of best evidence,the influence of the network remote evidence display on the cross-examination,and the restriction of the network trial cross-examination by technical equipment.Therefore,it is necessary to clarify the applicable conditions of online trial,strengthen the technical requirements of online trial,make full use of pre-trial meetings and strengthen the cooperation of various agencies to optimize online trial cross-examination.
