摘要
生态整体主义将有利于维护生态系统整体利益作为最高价值追求,实现了个体生命利益和自然生态系统整体利益的有机统一。其所秉承的生态完整性和生态平衡价值观将人类伦理关怀从人类共同体拓展到生态系统共同体,并要求维护代际生态正义,能够对原有的法律范式进行调整,构建以维护生态整体完整和平衡的生态法理。
Ecological holism regards the protection of the overall interests of the ecosystem as the highest value pursuit,and realizes the organic unity of individual life interests and the overall interests of the natural ecosystem.The values of ecological integrity and ecological balance inherited by ecological holism expand human ethical concern from human community to ecosystem community,and require the maintenance of intergenerational ecological justice.It can adjust the original legal paradigm and build ecological jurisprudence to maintain the integrity and balance of ecological integrity.
