摘要
数字政府的深入推进促进了行政法治的全面发展,行政方式因人工智能、大数据等技术的应用而得以不断创新,数字化政务服务提升了各级政府的服务水准,实现了跨层级、跨地域、跨业务协同。数字政府基于行政法治,有效地回应了数字经济和数字社会运行秩序的需求,既针对互联网平台设计监管规则,又为城市治理、基层治理提供平台依托。从未来的发展来看,组织协同、程序再造、自动化行政、算法、公共数据利用等亦给行政法治带来了挑战,行政法与技术的融合内涵需要进一步深入研究,引入"通过设计的行政法""良好行政影响评估"等原则,能否促进形成更高程度的合法性原则值得期待。同时,数字政府本身的建设模式也需符合民主法治的要求。这些课题均为未来研究提供了充裕的素材。
The in-depth promotion of digital government has promoted the all-round development of administrative rule of law. Administrative behavior has been continuously innovated due to the application of artificial intelligence, big data and other technologies. Digital government services have improved the service level of governments at all levels and realized cross-level, cross-region and cross-business collaboration. Based on the administrative rule of law, digital government effectively responds to the needs of the operation order of digital economy and digital society. It not only designs regulatory rules for the Internet platform, but also provides a platform for urban governance and grass-roots governance. From the perspective of future development,organizational coordination, program reengineering, automated administration, algorithms and public data utilization also pose challenges to the administrative rule of law. The connotation of the integration of administrative law and technology needs to be further studied. It is worth looking forward to whether the introduction of the principles of "administrative law by design" and "good administrative impact" can promote the formation of a higher degree of legitimacy principle. At the same time, the construction mode of digital government itself also needs to meet the requirements of democracy and the rule of law. These topics provide abundant materials for future research.
