摘要
清代三法司“两议”机制是应对中央司法审判工作的复杂性而产生的制度设计,有利于加强司法监督、制衡中央司法权、预防冤假错案、保证司法公正。然而,其在司法实践中也出现“两议”泛滥、法司对立等问题,扰乱司法程序、影响司法效率。在新时代深化司法体制改革的大背景下,该机制成功的经验与产生的问题,都值得今人借鉴与思考。
The“Two Recommended Judgments”,which is helpful in controlling the ministry of penalty,accomplishing check and balance in central judiciary,assuring judicial justice,and reducing misjudgment,is built to face the complexity of central judicial trial.However,in practice,the three judicial departments may fight for power and interest,censors may intentionally oppose the judgments or refuse to sign in the meeting to angle for praise,which interfere the normal judicial activity and reduces its efficiency.Consequently,only finding a balance between“Two Recommended Judgments”and contending among the three judicial departments,can the“Two Recommended Judgments”system work properly.
