摘要
科学、正确、符合国情的社区矫正顶层设计对社区矫正全国性的改革创新具有重要意义。我国社区矫正的方案是采取摸着石头过河与顶层设计相结合来设定的,但在顶层设计中存在指导思想不够清晰、设计目标不够明确、设计主体存在局限、设计思路不够大胆、设计方法不够科学等问题,由此导致社区矫正的整体运作水平不高,试点中的问题在面上重复出现,社区矫正的成效尚不能得到普遍认可。在社区矫正法已经颁布实施的背景下,仍然有必要完善社区矫正的顶层设计。在完善过程中需要强化决策程序的科学性,克服部门利益的掣肘,加强改革的系统性,提高改革的前瞻性。
The top-level design of community corrections,which is scientific,correct and in line with national conditions,is of great significance to the national reform and innovation of community corrections.The scheme of community corrections in China is set by crossing the river by feeling the stone and combining the top-level design.However,there are some problems in the top-level design,such as unclear guiding ideology,unclear design objectives,limitations of design subjects,bold design ideas and scientific design methods,which lead to the low overall operation level of community corrections.The problems in the pilot appear repeatedly,and the effectiveness of community corrections cannot be generally recognized.Therefore,under the background that the community correction law has been promulgated and implemented,it is still necessary to improve the top-level design of community correction.In the process of improvement,we need to strengthen the scientificity of decision-making procedures,overcome the constraints of departmental interests,strengthen the systematicness of reform and improve the foresight of reform.
