摘要
伴随数字经济的迅速发展,数字企业滥用市场支配地位的案件逐渐增多,危害日益严重,迫切需要反垄断法予以有效规制。然而,数字企业支配地位的形成具有特殊性,诸如网络效应、用户锁定效应和数据驱动等一系列数字平台企业所具有的特殊现象,使得传统市场支配地位认定方法面临诸多挑战。传统市场中普遍适用测试方法可能已经难以真实反映数字企业间的竞争状况,出现了相关市场难以界定的困境;而以市场份额推定经营者具有市场支配地位的方法在数字领域适用时也已备受质疑。基于此,采取对相关市场界定的清晰程度予以适当降低、完善主动调查机制、强化多元因素予以充分考量等方法,则为数字企业市场支配地位认定方法的改进提供了新的路径。
With the rapid development of digital economy,the cases of digital enterprises abusing their dominant market position are gradually increasing and the harm is becoming more and more serious.There is an urgent need for effective regulation by anti-monopoly law.However,the formation of the digital enterprises’dominant position is particular,digital platform enterprises have a series of special phenomena such as network effect,user lock-in effect and data driven,which make the traditional market dominant position identification method face many challenges.Generally applicable test methods in the traditional market may be hard to truly reflect the competition among digital enterprises,resulting in the dilemma that it is difficult to define the relevant market;The method of estimating the dominant market position of operators by market share has also been questioned when applied in the digital field.Based on above,measures such as appropriately reducing the clarity of relevant market definition,perfecting the active investigation mechanism and strengthening multiple factors are taken into full consideration,which provide a new path for the improvement of identification method in digital enterprises’dominant market position.
