摘要
《刑事审判参考》通过一系列典型案例,既阐释了合同诈骗罪的犯罪构成,也展现了解读犯罪构成的方法:根据合同诈骗罪的保护法益来确定“合同”的范围;通过分析“骗取财物”与“合同”的内在联系来明确合同诈骗罪的本质是“利用合同实施诈骗”;结合“利用合同实施诈骗”这一手段来限定合同诈骗的对象。总结和提炼合同诈骗罪典型案例中的裁判规则,对于解决骗取贷款、金融诈骗等犯罪的疑难问题具有指导意义:通过对诈骗犯罪中“欺骗行为”做实质判断,可以合理限定“欺骗行为”的范围;以履约能力和履约意愿为判断依据,可以使抽象的非法占有目的的判断具象化。个别典型案例在论证逻辑上明显不足,在结论上值得商榷,削弱了自身的指导价值。为此应当加强对案例事实的准确叙述,加强对犯罪构成的解读阐释和对典型案例的科学编撰,以进一步完善典型案例制度。
By citing a series of typical cases,the Reference Criminal Trials has not only explained the criminal composition of the crime of contract fraud,but also showed how to interpret the composition of the crime by using the following methods:to determine the scope of the“contract”according to the legal benefits of the crime of contract fraud;to define the essence of the crime of contract fraud as“using the contract to commit fraud”by analyzing the intrinsic link between“the act of defrauding”and“contract”;and to limit the object of contract fraud in combination with the determination of“using the contract to commit fraud”.Summarizing and refining the judgement rules in typical cases of contract fraud is of guiding significance for solving difficult problems of fraudulent loan,financial fraud,and other crimes:by making substantive judgments on“deceptive behaviors”in fraud crimes,the scope of these behaviors can be reasonably limited;based on the ability and willingness to perform the contract,the judgment of the abstract illegal possession purpose can be concretized.Individual typical cases are obviously insufficient in argumentation logic,and their conclusions are questionable,weakening their own guiding value.To this end,it is necessary to strengthen the accurate narration of case facts,enhance the interpretation of the composition of the crimes,and strengthen the scientific compilation of typical cases,so as to further improve the typical case system.
