摘要
在新体系施行适用的过程中,检察刑事附带民事公益诉讼的程序性设置是否应完全照搬民事公益诉讼的规定,司法实务体现不一,导致了诉讼程序不畅、诉讼责任障碍、诉讼门槛低等难题。对于检察刑事附带民事公益诉讼是否应当按照民事公益诉讼程序的相关规定适用诉前公告程序,其必要性和正当性值得探讨。
In the process of implementation and application of the new system, whether the procedural setting of civil public interest litigation incidental to criminal prosecution should completely copy the provisions of civil public interest litigation, the judicial practice reflects different, which leads to problems such as blocked litigation procedure, litigation liability obstacle and low litigation threshold. It is necessary and justifiable to discuss whether the public interest procedure attached to criminal prosecution should be applied in accordance with the relevant provisions of civil public interest procedure.
