摘要
中国进入新发展阶段之际,金融监管法治化水平能否提高,直接关系我国能否建立适应金融开放、金融改革、服务实体经济的健康金融体系。2008年国际金融危机引发的我国金融监管大变革,不仅创新并完善了宏观审慎与微观审慎并重的金融监管体系,形成了以中央监管为主之央地金融监管双层架构体制,而且守住了不发生系统性金融风险的底线。但也要看到,我国金融监管大变革所存在的法律供给不足问题。应通过制定统一"金融监管法",规范金融监管涉及的原则、概念、主体、措施、处罚等统一问题,明确金融监管机构的法律地位,授权金融监管机构制定适应分业要求的不同风险控制指标等标准。
As China enters a new stage of development, whether the level of legalization of financial supervision can be improved is directly related to whether China can establish a financial system that adapts to financial opening and reforms and serves the real economy. The great changes in my country’s financial supervision triggered by the international financial crisis in 2008 not only innovated and improved the financial supervision system that pays equal attention to both macro-prudential and micro-prudential, and formed a two-tier financial supervision system with central government’s supervision as the mainstay, but also safeguarded the bottom line of preventing systematic financial risks from happening. However, we must also be aware of the problem of insufficient legal supply in the great reform of my country’s financial supervision. Therefore, it is necessary to formulate a unified “financial supervision law” to regulate the principles, concepts, subjects, measures, penalties and other unified issues involved in financial supervision, clarify the legal status of financial supervision entities, and authorize financial supervision entities to formulate different requirements and specific standards such as risk control indicators for different industries.
