摘要
举办者在民办高校创立、存续过程中发挥着不可替代的作用。基于对法律、规章制度等政策法规以及民办高校现有章程的文本分析,梳理非营利性民办高校举办者责权历史脉络,判断应有应履责任与现实责任、应有权利与实有权利之间的差距,探索责权偏差的表象和原因。非营利性民办高校举办者责权的政策调适应明确非营利性民办高校举办者责任范畴与健全监管机制,健全非营利性民办高校举办者权利内涵及保障机制。
Organizers play an irreplaceable role in the establishment and survival of private colleges.Based on the text analysis of laws,rules and regulations as well as the existing articles of association of private colleges,this paper sorts out the historical context of the responsibility and right of the organizers of non-profit private colleges,judges the gap between due responsibility and actual responsibility,due right and actual right,and explores the appearance and causes of the deviation of responsibility and right.In the policy adjustment of the responsibilities and rights of the organizers of non-profit private colleges,we should clarify the responsibility category of the organizers of non-profit private colleges,perfect the supervision mechanism,and improve the connotation and guarantee mechanism of the rights of the organizers of non-profit private colleges.
