摘要
认罪认罚从宽制度的核心是量刑精准化,量刑精准化不仅是实现该项制度效能最优化的重要内容,也是近二十年来量刑规范化的目标追求。认罪认罚从宽制度视阈下的量刑精准化,经历了从幅度刑到确定刑的变化,承载着实现认罪认罚从宽制度的程序价值和实体价值。随着精准量刑工作推进实施一年多以来,实践中产生了法检两机关对“从宽”认知分歧、“从宽”未兑现、值班律师参与深度不够、犯罪嫌疑人对“量刑协商”和刑期计算存在误解等诸多问题,不仅影响了量刑建议采纳率,更影响了认罪认罚从宽制度的有效落实,需要检察机关充分发挥主导责任进行更多探索,使精准量刑符合公众认知的一般期待,推进精准量刑工作高质量发展。
The core of the leniency system is the precision of sentencing.The precision of sentencing is not only an important content to achieve the optimization of the system's effectiveness,but also the goal of standardization of sentencing in the past two decades.The precision of sentencing under the leniency system of confession and punishment has undergone a change from range punishment to definite punishment,which carries the procedural and substantive value of realizing the leniency system of confession and punishment.As the implementation of precision sentencing work for more than a year,there have been differences in the perception of“leniency”between the two agencies in practice,“leniency”has not been fulfilled,on-duty lawyers are not sufficiently involved in depth,and suspects have negotiated“sentencing”.Misunderstandings in the calculation of sentences have not only affected the adoption rate of sentencing recommendations,but also affected the effective implementation of the system of plea guilty and punished leniency.The procuratorial organs need to give full play to their leading responsibilities and carry out more explorations to make precise sentencing conform to the general public perception.We look forward to promoting the high-quality development of precision sentencing.
