摘要
为我国更好适应知识产权国际保护参与双边、区域、多边贸易规则重构的挑战,本研究以亚太区域主要经济体之间所签订的明确包含知识产权规则且保护强度超出WTO框架下TRIPS所包含内容的63份自贸协定文本和联合国统计的126组贸易数据为对象,进行FTA知识产权规则保护强度测评及分析,并在此基础上构建引力模型,针对FTA知识产权规则变革对国家出口产品贸易结构的影响作用展开实证研究。研究发现:加强自由贸易协定文本中有关知识产权规则保护强度的条款对发展中国家出口贸易结构的提升不如发达国家明显。为此,本文提出我国政府面对FTA双边、多边贸易协定签订过程中,短期内应尽量削弱知识产权保护强度加大带来的消极影响,长期内应积极制定政策倒逼各类出口优势产业关注自身知识产权建设,促使其转型升级的对策建议。
In order for our country to better adapt to the challenge of the international protection of intellectual property rights in the reconstruction of bilateral,regional and multilateral trade rules,this study uses the rules signed between the major economies in the Asia-Pacific region that clearly include intellectual property rules and the protection intensity exceeds that of TRIPS under the WTO framework.The content includes 63 free trade agreement texts and 126 sets of trade data collected by the United Nations as the object,and conducts assessment and analysis of the protection intensity of FTA intellectual property rules,and builds a gravity model on this basis to target the country’s export product trade in response to the changes in FTA intellectual property rules.Empirical research on the impact of structure.The study found that the strengthening of the provisions on the protection of intellectual property rights in the text of the free trade agreement has not improved the export trade structure of developing countries as much as that of developed countries.To this end,this article proposes that in the process of signing FTA bilateral and multilateral trade agreements,the Chinese government should try to reduce the negative impact of increased protection of intellectual property rights in the short term,and in the long run should actively formulate policies to force various export-leading industries to pay attention to their own knowledge.The construction of property rights promotes its transformation and upgrading countermeasures and suggestions.
