摘要
“行政许可”是对于市场(社会)主体实施特定行为广泛使用的一种行政行为,但是在市场(社会)主体提供“公共服务”的政策情境下,因公共服务提供关涉公民“社会权利”和政府基本职责而使许可的功能发生了变化。这为分析行政许可的规制目标、价值及其规制功能实现条件提供了新的面向。近年来我国的教育改革实践表明,行政许可在对市场(社会)主体提供公共教育服务实行“事前”控制方面,并非与其他行业一样呈现放宽准入的趋势,同时,其行为监管呈现了向“事中、事后”延展、使用者和专业机构参与实施监管、增加监管强度等趋势。市场(社会)主体提供公共教育服务的政策情境,使行政许可实施过程中在教育行业标准采纳、许可续期及退出,以及服务使用者参与规制等方面发生了明显变化。为此,当前亟须拓展对于教育领域行政许可的认知,为重新审视行政许可的规制功能提供新的洞见,使其更好地捍卫教育活动的公共价值。
"Administrative license"is a kind of administrative behavior widely used for market(social)subjects to carry out specific behavior.However,in the policy context of market(social)subjects to provide"public service",the function of license has changed due to the fact that the provision of public service is related to citizens’"social rights"and the basic responsibilities of the government.This provides a new perspective for the analysis of the regulatory objectives,values and conditions for the realization of regulatory functions of administrative licensing.In recent years,China’s education reform practice indicates that the pre-control of administrative licensing concerning the provision of public education services by market(social)subjects doesn’t display the trend of widening access like other industries,at the same time,its behavior supervision displays the trend of extending to"in-process supervision and post-supervision",users and professional institutions participating in the implementation of supervision,increasing supervision intensity and so on.The policy context in which the market(social)subjects provide public education services triggers obvious changes in the implementation of administrative licensing in terms of the adoption of educational standards,renewal and withdrawal of licensing,and the regulation on the participation of service users.Therefore,it is urgent to expand the cognition of administrative license in the field of education and provide new insights for re-examining the regulatory function of administrative license so as to better protect the public value of educational activities.
