摘要
刑法解释方法对刑法解释结论有效性的确证功能的类型化与体系化,应当成为功能主义刑法解释方法论的重要命题。只有在刑法的文义解释方法、论理解释方法、刑事政策解释方法依次对解释结论的合法性、合理性、合目的性的确证功能全部实现之时,才能最终确证刑法解释结论有效性"三性统一体"。刑法解释方法确证功能的体系化逻辑只能是将三类刑法解释方法的竞争关系论与平行论改造为功能结构关系论与共生融合论:首先需要进行文义解释,确证解释结论的合法性底线基础价值和合法空间;其次需要进行论理解释和刑事政策解释,在合法性底线基础价值之上进一步求证合法空间可包容的合理性和合目的性优化价值并遴选出"最优化价值",以确保实现刑法解释结论有效性"三性统一体"。刑法解释方法确证功能的体系化路径只能是先进行文义解释,后进行论理解释和刑事政策解释,在解释过程中,可以进行解释性循环。解释性循环并不否定刑法解释方法确证功能体系化。
The categorization and systematization of the confirmable function of interpretation methods of criminal law to verify the validity of conclusions should be an important proposition of functionalism interpretation methodology of criminal law. Only when the literal interpretation, logical interpretation, and criminal policy interpretation of the criminal law fully realize the corroborating functions of legality, reasonability, and purposiveness, the trinity validity of the interpretation conclusion of criminal law could be eventually confirmed. The systemic logic of confirmable function can only transform the competitive relationship and parallelism of the three types of methods into the functional structure relationship and symbiosis theory. First of all, literal interpretation is crucial to confirm the basic value and legal space of the bottom line of the interpretation conclusion. Secondly, logical interpretation and criminal policy interpretation are required to further verify the reasonability and purposiveness value of interpretation conclusion on the basis of the bottom line value of legality and select the “optimal value” to ensure the trinity validity. The systematic path of the validity of the interpretation conclusion of criminal law can only be the literal interpretation first, followed by the logical interpretation and criminal policy interpretation, and the hermeneutical circle can be carried out in this process. The hermeneutical circle does not negate the systematization of the confirmable function of interpretation methods of criminal law.
