公平优质受教育权:权利义务关系与实现可能 被引量:1

The Right to Fair and High-Quality Education:the Relationship between Rights and Obligations and the Possibility of Realization

摘要 在倡导基础教育高质量发展背景下,受教育权演进为公平优质受教育权是时代的要求。在教育资源有限的情况下,受教育权应当按照义务教育阶段与非义务教育阶段的划分,逐步进阶为公平优质受教育权。受教育权的权利义务模型应当是“公民权利-国家义务”模型。在不同的教育阶段,国家承担的义务限度有所不同。结合我国当前实践,公平优质受教育权具备实现可能,其中义务教育阶段是受教育权朝着公平优质受教育权整体演进的起点及基础。 Under the background of advocating high-quality development of basic education,the evolution of the right to education into a fair and high-quality right to education is the requirement of the times. In the case of limited educational resources, the right to education should follow the stage of compulsory education and non-compulsory education, and gradually advance to the right to fair and high-quality education. The right and obligation model of the right to education should be the model of “civil rights-state obligations”. At different stages of education, the limits of obligations undertaken by the state are different. Combined with China’s current practice, it is possible to realize the right to fair and high-quality education, and the stage of compulsory education is the starting point and foundation for the overall evolution of the right to education to the right to fair and high-quality education.
