商品包装反不正当竞争的法学与经济学分析——以“伊利诉蒙牛不正当竞争案”为例 被引量:1

摘要 商业混淆行为是一种常见的不正当竞争行为,一些竞争者以假冒、仿冒的手段来侵害其他合法竞争者的利益,造成混淆,扰乱正常的市场竞争秩序。"擅自使用相同或相似的商品包装、装潢等标识"是《反不正当竞争法》中明确规定的商业混淆行为。在强调多元化经济的时代,商品包装装潢在市场竞争中扮演着越发重要的角色,投机者利用与他人易造成混淆的商品包装、装潢来误导消费者的选择,损害竞争秩序。因此,对商品包装、装潢的法律保护十分重要。 Commercial confusion is a common unfair competition behavior.Some competitors infringe on the interests of other legitimate competitors by means of counterfeiting and counterfeiting,resulting in confu-sion and disturbing the normal market competition order"Unauthorized use of the same or similar commodity packaging,decoration and other marks"is a commercial confusion act clearly stipulated in the anti unfair competition law.In the era of emphasizing diversified economy,commodity packaging and decoration plays an in-creasingly important role in market competition.Speculators use commodity packaging and decoration that are easy to confuse with others to mislead consumers’choices and damage the competition order.Therefore,the le-gal protection of commodity packaging and decoration is very important.
