摘要
集体经营性建设用地入市的增值收益分配关乎国家、集体与个人利益。当前,增量集体经营性建设用地入市面临着法律约束、补偿标准空白等制度困境,增值收益分配存在分配原则模糊、入市成本分担机制待完善等现实问题。未来改革中应当健全城乡统一的土地利用规划法律制度,建立规范的“农转用”补偿标准,进一步扫清增量集体经营性建设用地入市的制度障碍;健全农村土地市场机制;制定科学合理的增值收益分配制度,同时明确集体提留土地增值收益的用途,制定收益使用的监管机制,保障增量集体经营性建设用地入市改革的顺利进行。
The marketed incremental benefit distribution of collective operating construction land deals with the interests of the state,collective and individual.At present,the marketed incremental collective operating construction land is facing institutional dilemma such as legal constraints and blank compensation standards.Meanwhile,there are practical problems in the distribution of incremental benefit such as indistinct distribution principle and imperfect marketed cost-sharing mechanism.In the future reform,it’s necessary to improve the unified urban-rural land use planning system,establish the normative compensation standards of rural land converted into collective operating construction land,and remove the institutional barrier to marketed incremental collective operating construction land.It’s important to improve the market mechanism of rural land.It’s indispensable to establish a scientific and reasonable distribution system of incremental benefit,clarify the use of incremental benefit of collective retained land,formulate a supervision mechanism of benefit use and safeguard the smooth marketed reform of incremental collective operating construction land.
