摘要
尽管高丽律令格式体系的存在是一个确定不移的事实,但在内容与样态上又与唐制存在重大差异,具有自身的特点。法典的框架性与有限的系统性、法典的简单化与法条的直观化、法典的个别化倾向及彼此间界限的融通以及游走于华化与土俗间的法典内容,是高丽律令格式法律体系的基本特征。这些特征基本均基于高丽特定的国情,是朝鲜半岛与中国在政治、文化、社会诸层面存在“落差”的产物。
The Koryo law format system is significantly different from the Tang system and has its own characteristics in terms of the content and style.The framework and limited system of the code,the simplification of the code and the visualization of the legal provisions,the tendency of individualization of the code and the open boundaries between each other,and the contents between“the Chinese-style”and“local customs”are the basic characteristics of Koryo law format system.These characteristics are based on the specific national conditions of Koryo,and the product of the“gap”between the Peninsula and China on political,cultural,and social levels.
