摘要
作为“以房养老”主要模式的反向抵押兼具金融产品属性,而老年人意思能力的退化和金融素养的缺失决定了其在参与反向抵押过程中的弱势地位,容易受到混淆式营销、误导性广告、欺诈性营销、捆绑式销售等不当营销模式的损害。为避免“以房养老”政策落空,可考虑从“内”“外”两个层级对老年人利益进行保护。内部层级应在法律性质上以“终身定期金合同”+“新型担保方式”对反向抵押合同进行定性,同时改革成年监护制度,通过公共监护介入反向抵押,补足老年人意思能力。外部层级应当秉持市场监管与营商环境优化并重原则,通过营造反向抵押市场的良性法治环境实现保护老年人利益的目的。
As the main model of “House for Pension”,reverse mortgage has financial product attributes.Due to the deterioration of capacity of will and lack of financial literacy,the elderly has weak position in reverse mortgage and easily suffers from improper marketing models such as confusing marketing,misleading advertising,fraudulent marketing and bundling sales.In order to avoid the failure of the “housing pension” policy,we can consider protecting the interests of the elderly from the two levels of “inside” and “outside”.In order to avoid the failure of “House for Pension” policy,the elderly protection method shall be established both from “inside” and “outside” levels.At inside level,the reverse mortgage should be characterized as “annuity for lifetime contract” + “new type of guarantee”.Meanwhile,the adult guardianship system shall be reformded,and the old people’s capacity of will shall be supplemented through the public guardianship intervening in the reverse mortgage.At outside level,for realizing the purpose of protecting the interests of the elderly by creating a benign legal environment in the reverse mortgage market,equal attention shall be paid to the market supervision and business environment optimization.
