摘要
官员直播带货是直播带货与政务服务的交叉领域,是兼具公私两种属性的复合形态,在行为内容、主体定位和法律性质上存在着有别于一般直播带货的特殊性,导致两者所面临的法律风险和规制路径也存在着较大的区别。官员直播带货面临着廉政纪律、广告责任、限制竞争、产品责任以及网络安全5种主要的法律风险形态。对此,可以从中立性和公益性的定位、广告内容的审核、产品责任的划定、程序规范的约束4个方面化解官员直播带货的法律风险。
Official live broadcasting is an interdisciplinary field of live broadcasting and government services.It is different from the general live broadcasting in terms of behavior content,subject orientation and legal nature,which leads to great differences in legal risks and regulatory paths.There are five main types of legal risks in official live broadcasting,which are the risk of integrity and discipline,the risk of advertising liability,the risk of limited competition,the risk of product liability and the risk of network security.In this regard,we can resolve the legal risk of official live broadcasting from four aspects:neutrality and public welfare orientation,advertising content audit,product responsibility delimitation and procedural constraints.
