摘要
病历书写错误、病历记录不及时、病历修改、病历资料矛盾、病历资料不完整、病历资料保管不善以及隐匿、伪造、篡改病历资料等作为常见的病历"问题",普遍存在于医疗损害责任纠纷中,是患者及其代理律师关注的重点。本文通过对医疗损害责任案例的统计以及医疗实践观察,从病历"问题"是否影响医疗行为,是否对医疗过失行为的认定有实质影响来分析病历"问题"对医疗损害原因力及损害责任的影响。通过探讨病历"问题"在医疗损害原因力及损害责任中的影响,有利于鉴定人缕清鉴定思路,便于法官判案时区分原因力,确认医疗损害责任。
Medical record writing errors,untimely medical records,modification of medical records,contradictions in medical records,incomplete medical records,improper storage of medical records,and concealment,forgery,and tampering of medical records are common medical records’ problem that exist in disputes over liability for medical damage,which are the focus of attention of patients and their lawyers.Based on the statistics of medical damage liability cases and the observation of medical practice,this article analyzed the causative force and medical damage liability from whether the medical records’ problems affect medical behavior and whether there has a substantial impact on the identification of medical negligence.By discussing the influence of medical records’ problems on the causative force and medical damage liability,it’s helpful for the appraiser to clarify the ideas during the appraisal,and convenient for the judge to distinguish causative force and confirm medical damage liability.
