摘要
现代法学教育与大学教育紧密结合在一起,并作为一种教育模式而传承悠久。针对人们对法学教育的诟病,提出法学教育应当有自己的良心坚守。在文科时代,要培养法律人,能够进行法律分析、运用法律方法逻辑推理,并能够进行正当性衡量,这是法学教育的技术坚守;要培养法治人,能够提供优质的法律服务,具有较高的公共责任意识,具有较好的家国担当精神,这是法学教育的价值坚守;要培养法理人,能够承继法治文化、弘扬法治精神并创新法治文化,这是法学教育的文明坚守。法律人、法治人和法理人,各有使命,但又互相统一,一起构成新时代中国法学教育的核心使命。
Contemporary legal education is closely integrated with higher education,which has been inherited with a long history as an education model.In response to people's criticism of legal education,it is proposed in this paper that legal education should have its own persistence.In the era of“New Liberal Arts”,it is necessary to cultivate legal talent who can conduct legal analysis,apply legal methodology and logical reasoning,and be able to measure justice and legitimacy.This is the technical adherence in legal education.In the meantime,it is necessary to cultivate legal talent who can provide high-quality legal services with high a sense of public responsibility and a good contribution spirit for both the family and the country.This is the value adherence in legal education.It is also necessary to cultivate legal talent who can inherit and innovate the culture of rule of law,promote the spirit of rule of law.This is the civilization adherence in legal education.All of the law professionals,the professionals of rule of law and the jurisprudents have their independent missions and unified objectives,which together constitute the core mission of contemporary legal education in China.
