摘要
软硬法混合治理是高校教授治学法治化的重要特色。学术不端裁决权是教授治学相关软硬法制度文本的重要内容。通过对16所高校学术委员会章程中学术不端裁决内容的规定与相关硬法进行比较,发现各高校相关软法并无严格遵循上位法与下位法一致原则。分析发现,部分高校学术委员会的学术不端裁决权被架空,硬法给予的处理权或处理建议权被剥夺或被顶替,部分高校相关软法程序缺失或粗化等是当前教授治学相关软法与硬法冲突的主要表现。为完善教授治学软硬法制度文本中相关内容,应做到软法硬"立",完善高等学校学术委员会章程的校内审议与校外核准程序;应软法硬"依",严格落实上位法赋予学术委员会的职责权限,发扬软法优势,让软法细致化、个性化,依据各校特点细化学术委员会裁决学术不端的程序。
The mixed governance of soft and hard law is an important feature of the legalization of university professors’ academic research. The adjudication right of academic misconduct is an important part of the text of the soft and hard law system related to professor’s academic governance.By comparing the stipulations of adjudication right of academic misconduct in the articles of academ-ic committees in 16 universities with the relavant hard laws,it is found that the relevant soft laws of universities do not strictly follow the principle of consistency between the upper law and the lower law. The analysis shows that some universities’ academic committees have no right of academic misconduct discretion,the right of disposal or suggestion given by the hard law is deprived or replaced,and some universities’ soft law procedures are missing toughness,which are the main manifestation of the conflict between soft and hard laws in professors’ academic governance. To improve the relevant content in the text of the soft and hard law about professor’s academic governance,it is necessary to establish the strict soft law system and improve the internal review and external approval procedures of the articles of the academic committee of higher education. The process should strictly abide by the soft law,strictly implement the responsibilities and powers granted to the academic committee by the superior law,develop the advantages of the soft law,make the soft law meticulous and personalized and refine the procedures for academic committee to adjudicate acadmic misconduct procedure according to the characteristics of each university.
