摘要
良好的乡村生态环境是乡村全面振兴的重要建设内容和保障,也是推进乡村治理体系和治理能力现代化的扎实基础。当前乡村生态环境治理举步维艰,其中重要的原因就是在环境规制方面存在很多问题。中办、国办在2019年印发的《关于加强和改进乡村治理的指导意见》中提出建立乡村治理工作的协同推进机制,其中就包括司法行政要协同配合,形成合力。从社会性规制角度分析,行政规制和司法规制也是乡村生态环境治理中的两种最优选择,由于各有利弊,因此不能择一或替补适用于解决复杂的乡村环境问题。结合目前行政规制在乡村治理中的主导地位以及司法规制的效能发挥不足等现状,需要重点披露行政规制之弊端,对比总结司法规制之优势,从而在信息获取、规制程序启动以及机会主义倾向等方面探究两者互补式的内在协同规制路径,提升乡村治理效能,推进乡村生态环境治理的现代化进程。
A good rural eco-environment is an important construction content and guarantee for overall rural revitalization,and a solid foundation for the modernization of rural governance system and governance capacity.At present,the main reason for the difficulties in rural eco-environmental governance is that there are many problems in rural eco-environmental regulations.In Guiding Opinions on Strengthening and Improving Rural Governance issued in 2019,the General Office of the CPC Central Committee and the General Office of the State Council proposed the establishment of a collaborative promotion mechanism for rural governance,including the coordination of judicial administration to form synergy.From the perspective of social regulation,administrative regulation and judicial regulation are also the two optimal choices in rural eco-environmental governance.Due to their respective advantages and disadvantages,they cannot be chosen or substituted to solve complex rural environmental problems.Combined with the current status of administrative regulation in rural governance and insufficient effectiveness of the administrative regulation,it is necessary to disclose the shortcomings of administrative regulation,compare and summarize the advantages of the administrative regulation,so as to explore the internal coordination of the two complementary paths of rules and regulations,improve rural governance efficiency,and promote the modernization of rural eco-environmental governance.
