摘要
欧盟为了促进数据的流动与使用,消除各成员国由于政策差异导致的数据流动壁垒,制定了数据战略,并围绕数据的保护和促进使用采取了一系列措施,如根据数据处理程度确定保护级别,打造垂直的治理体制,构建欧盟内统一的数据治理框架,打造单一数据空间等。欧盟认为,个人、私营部门和公共部门等数据主体组成了数据空间,因此出台多项法律明确了三者的权利与义务,并致力于推动不同数据主体之间的数据共享和使用。在数据流动中,各数据主体之间的不信任成为最大问题,为此欧盟建立数据安全认证机制、大力发展第三方数据共享服务和数据利他组织,并制定相关监管措施,促进数据要素的流动与使用。对我国而言,应该借鉴欧盟经验,加强数据治理顶层战略制定,完善数据治理管理体制,大力发展数据中介服务,完善各类法律体系建设。
In order to promote the flow and use of data and eliminate the data flow barriers caused by policy differences among member states,the EU has formulated data strategy,and done a series of work around the protection and promotion of data use,such as determined the protection level according to the degree of data processing,created a vertical governance system,and tried to build a unified data governance framework within the EU,created a single data space.The EU believes that data subjects such as individuals,private sectors and public sectors constitute the data space.Therefore,a number of laws have been issued to clarify the rights and obligations of the three,and are committed to promoting the data sharing and use among different data subjects.In data flow,distrust among data subjects becomes the biggest problem.Therefore,EU established data security authentication mechanism,vigorously developed third-party data sharing service and data altruism organization,and formulated regulatory measures to build a credible data flow mechanism and promote the use of data elements.For China,we should learn from the experience of the EU,strengthen the top-level strategy formulation of data governance,improve the data governance management system,vigorously develop data intermediary services,and improve the construction of various legal systems.
