摘要
自家事审判改革以来,上海市长宁区人民法院(以下简称“长宁法院”)通过设置专业的家事法庭、组建专业法官团队、创新家事审判相关制度等举措对家事审判改革进行了有益的探索。但是,长宁法院在家事审判改革的过程中也发现了程序立法不足、证据规则缺陷等问题。据此,本文以长宁法院进行家事审判改革以来的实际运行状况作为考察样本,分析改革过程中遇到的问题及可能的解决方案,以期为我国的家事审判改革完的善路径提供有益借鉴。
Since the family trial reform began,Shanghai Changning District People's Court(hereinafter referred to as Changning court)has carried out beneficial exploration on the family trial reform by setting up professional family court,establishing professional judge team and innovating the relevant system of family trial.However,in the process of family trial reform,Changning court also found some problems,such as insufficient procedural legislation and defects of evidence rules.Accordingly,this paper takes the actual operation of Changning court since the family trial reform as an investigation sample,analyzes the problems encountered in the reform process and possible solutions,in order to provide beneficial reference for the improvement of family justice in China.
