摘要
新媒体环境中声像档案利用需求的多样性、技术性、层次性和教育性等特征为其立法及依法管理开发利用服务等带来了新的机遇和挑战。文章选取美国、法国、新加坡、中国澳门地区档案法中有关声像档案管理的法律条文,运用比较研究法对四个国家和地区档案法中声像档案的法理界定、形成来源、开放利用、保存措施、人员规范等内容进行深入分析并比较其异同点,最后据此探讨完善我国声像档案立法及提升其管理服务的思路和对策,即尽快健全完善声像档案制度建设相关内容、强化法律和服务意识以明晰管理主体权责关系、充分发挥声像档案研究机构的积极作用等,以期为我国档案领域深入开展声像档案研究开发利用等提供参考或借鉴。
In the new media environment,the diversified,technical,hierarchical and educational requirements of audio-visual Archives bring new opportunities and challenges for their legislation and management,development and utilization services.Article selected the United States,France,Singapore,China,Macao legal provisions on the management of audio and video files in the Archives law,comparison study method to the Archives law of the four countries and regions of audio-visual Archives legal definition,forming source,open utilization,saving measures,personnel specifications,and other content analysis and compare the differences and similarities,This finally on the basis of perfect our legislation of audio-visual Archives and promote the thinking and countermeasures of management services,namely the construction of audio-visual Archives system sound as soon as possible the related content,strengthening the legal relationship between power and responsibility and the law and service consciousness to clear management subject,give full play to the positive role of audio-visual Archives research institutions,etc.,in order to in-depth development in the domestic field of Archives audio-visual Archives research use or offer reference.
