摘要
我国现行《反不正当竞争法》并未对视频广告屏蔽行为作出明确规定,而实务界对于此类行为多以一般条款认定该行为破坏了既存的商业模式,构成不正当竞争。法院几乎以绝对权思维为相对性的竞争利益排他性地划定了竞争行为的界限。这不仅忽视了保护消费者利益的立法目的,而且偏离了鼓励创新和保护竞争的立法初衷。对视频广告屏蔽行为的正当性与否进行评价时,要对商业模式、竞争开发产品行为以及消费者利益三者进行综合考量,尤其要重视对消费者利益的考量。在考量竞争者的开发产品行为时,主观恶意是重要考量因素,其中包含是否具有针对性和是否存在恶意引诱行为等内容。
Our country’s current Anti-Unfair Competition Law does not have any definite stipulations about the screening behavior for video advertisements. However,the practice circle generally determines that such behavior has violated the existing business model,and constitutes unfair competition. The court almost has exclusively delineated the boundaries of competitive behavior with absolute power thinking as the relative competitive interests. This not only ignores the legislative purpose of protecting consumer interests,but also deviates from the legislative value of encouraging innovation and protecting competition. When evaluating the legitimacy of screening behavior for video advertisements,comprehensive consideration should be given to the business model,competitive product development behavior and consumer interests,with particular emphasis on the consideration of consumer interests. When considering the behavior of competitors in developing products,subjective maliciousness is an important factor to be considered,including whether it is targeted and whether there is malicious inducing behavior.
