摘要
我国司法体系正在完善类案检索机制,类案检索是借助信息服务平台,发现应当参照或可以参考的先例的法律专业技能,是网络信息技术时代下科技赋能法律的重要体现。为了适应司法实践的深刻变化,促进法学教育改革,有必要在法学本科中开展类案检索教学。教师可以从案例分析、类案检索和检索报告三个部分开展示范教学,指导学生独立完成类案检索报告,提高学生信息检索与应用的能力,帮助学生适应“互联网+法律”的行业新变革。
China's judicial system is improving the mechanism of similar case retrieval.Similar case retrieval is a professional legal skill to find precedents that should be referred to or can be referred to with the help of information service platform.It is an important embodiment of science and technology enabling law in the era of network information technology.In order to adapt to the profound changes of judicial practice and promote the reform of legal education,it is necessary to carry out the case retrieval teaching in undergraduate law.Teachers can carry out demonstration teaching from three parts:case analysis,similar case retrieval and retrieval report,guide student to complete report of similar case retrieval independently,improve students'ability of information retrieval and application,and help students adapt to the new industry reform of"Internet+Law".
