摘要
与国有企业普遍设立法务部门并建立全方位的法律风险防控机制对比,国内三甲医院设立独立法务部门寥寥无几,究其原因在于医疗系统长期固有的思维是以医疗业务、科研、教学为管理重心,不重视法治建设,导致整个医疗行业的法治意识薄弱。现代化医院要使改革落到实处,必须让管理的各个领域都要在法治的轨道上前行,这离不开医院内部法务部门的保驾护航。本文综合运用问卷调查、实地调研、比较研究等研究方法,通过调查问卷收集福建省内三甲医院法务工作的实施现状,并分析美国和我国台湾地区医院法务建设的实践和做法,实地考察山东省某三甲医院的法务建设,论证在三甲医院设立独立法务部门具有紧迫性和必要性,并尝试对我国三甲医院独立法务部门的建设提出见解和思考。
Compared with the state-owned enterprises to set up the legal department and establish a comprehensive legal risk prevention and control mechanism,few domestic gradeⅢclass A hospitals set up an independent legal department.The reason is that the inherent thinking for a long time of medical system is based on medical service,scientific research and teaching management,it ignores legal construction which lead to rule of law is weak in the entire medical profession consciousness.modern hospitals must make the reform to be implemented,and make the management of every field move forward on the track of law,which depend on protecttion of legal department.This research contained three kinds of methods,which were questionnaire investigating method,on-the-spot observing method,and comparative method.We collected implementation status of gradeⅢclass A hospitals in Fujian through the questionnaire,analyzed experiences on the legal construction of the public hospital in the United States and Taiwan,and investigated one gradeⅢclass A hospital in Shandong for field trips.to demonstrate urgency and necessity of establishing an independent legal department in gradeⅢclass A hospital,and try to put forward some views and thinking in establishing an independent legal department in gradeⅢclass A hospital.
