摘要
基于国际法治视野,从问责对象、问责主体、问责内容以及问责方式四个方面探析国际足联问责制并解读国际足联腐败问题。国际足联作为问责对象,由于组织属性以及在国际足坛的垄断地位增加了外界对其的问责难度。国际非政府组织、跨国集团、国家、国际政府组织以及个人等各利益相关者作为国际足联的问责主体,受限于内外因素,存在问责监督无力的情况。问责内容主要体现在组织问责方面,国际足联内部机构设置不断强化高度集权,导致决策、行政与执行三权边界模糊等问题。在实践中,以公开透明为主的多种问责方式包括自律、报告和信息公开、评估、社会监督以及参与等都几近失效。相对于国际足联我国体育组织虽受到政府监管和法律管控,但新时期推进我国体育协会深化改革应以国际足联为鉴加强问责制建设,确保我国体育组织健康发展,更好地服务于我国体育事业发展。
Based on the international rule of law,the paper discusses the FIFA accountability system and interprets the FIFA corruption in the aspects of accountability object,accountability subject,accountability content and accountability method.FIFA,as the object of accountability,is hard to be held responsible for misconducts due to its organizational attributes and monopoly in international football field.International non-governmental organizations,multinational groups,national,international government organizations and individuals,as the accountability subjects of FIFA,always lack enough accountability supervision due to the internal and external factors.The content of accountability is mainly reflected in organizational accountability.FIFA's internal institutions have continuously strengthened the high degree of centralization,leading to the vague boundary between the three powers of decision-making,administration and implementation.In practice,a variety of accountability methods focusing on openness and transparency,including self-discipline,reporting and information disclosure,evaluation,social supervision,and participation,have all nearly become ineffective.China's sports organizations are subject to government supervision and legal control and in order to promote the deepening reform of China's sports associations in the new era,it is necessary to strengthen the construction of the accountability system with FIFA as a mirror,to ensure the healthy development of China's sports organizations,and to better serve the development of China's sports undertakings.
